Land Use Initiative - Munster

GNIAR has utilized The National Association of REALTORS® Land Use Initiative which uses a real estate law firm to review laws and ordinances pertaining to real estate land use.  Below please find a copy of a letter to TC Pres Joe Simonetto that includes the information from the NAR provided memorandum.  Lee Ann Mellon introduced an ordinance that would restrict franchise businesses, under certain conditions, from locating in Munster.

Yesterday the Consumer Financial Protection Bureau (CFPB) announced that it would be “sensitive” to companies that make a good-faith effort to comply with the new Truth in Lending Act and Real Estate Settlement Procedures Act Integrated Disclosure (TRID) regulation that goes into effect on August 1, 2015. This is a welcome development that can be compared to the effective CFPB implementation of the Qualified Mortgage (QM) regulation in 2014.  

Bottom Line: The announcement by CFPB is a net win but less than what some Members of Congress requested, which was a hard deadline five-month testing or “grace” period.

Next Steps:  NAR has been leading the effort to ensure an effective implementation of the TRID regulation.  We will continue to have a dialog with Congress and the CFPB as we move toward August 1, 2015.  It was through our member efforts during the 2015 REALTOR® Legislative Meetings and Trade Expo that more than 275 U.S. Senators and Representatives signed onto a letter to CFPB Director Richard Cordray to ask for the clarification that was issued yesterday.

During the November 2014 GNIAR board meeting, the board of directors voted to approve five resolutions recommended by the GNIAR Government Affairs Committee.  Read GNIAR’s position statements below:

Effective immediately, all Merrillville property owners that have mandatory flood insurance should see their premiums drop by 15%. Owners of parcels that have insurable structures located in a 100-year flood zone (delineated by the Federal Emergency Management Agency, or FEMA) are required to obtain flood insurance by their lenders. These areas are shown on the latest FEMA Flood Insurance Rate Maps (FIRMs).

Residents will see a reduction in their flood insurance premiums through efforts of Merrillville Stormwater Utility Executive Director Matt Lake, who has been working with the FEMA Community Rating System (CRS) program. After applying for the program and coordination with Christina Groves from FEMA, Merrillville is one of about 20 communities in Indiana who are ranked within the program. Merrillville received the best ranking in Indiana, a Class 7, in order to qualify for reduced rates in flood insurance, with only Hamilton County also receiving a Class 7 ranking. The Town of Merrillville was the first to apply in Northwest Indiana.
